On PGMA's declaration of Martial Law

We woke up this morning to President Gloria Macapagal-Arroyo declaring Martial Law over Maguindanao and nearby provinces in the south.

Under Section 18 Article VII, Martial Law can only be declared if there is an invasion or rebellion. Neither is existing in the case of the Maguindanao massacre. The massacre is neither a rebellion nor an invasion but a case of multiple murders involving government officials loyal to President Gloria Macapagal-Arroyo. The truth is all key personalities are now under police custody. The factual basis for a Martial Law declaration therefore appears to be inexistent.

Labag sa Saligang Batas ang nasabing deklarasyon. Tulad ng EO 464 at Proclamation 1017 dapat ibasura ang proklamasyong ito dahil ito ay kontra sa Saligang Batas. Hindi na kailangan ang proklamasyon upang mapaaresto ang mga salarin. At base sa mga reports ay naaresto na ang mga Ampatuan.

Dapat bawiin na ni Gloria ang nasabing proklamasyon.

..korak! di kailangan ang martial law para ma solve ang ampatuan mass killing. baka naman may kailangan itago kaya sya nagdeclare ng martial law? hmmmmmmm

The real danger here is that declaring martial law in Maguindanao could be a prelude to martial law on the whole country, Wisen up Philippines! Gloria has brazenly broken our trust soooooooo many times!

There are plenty of things to hide from the press and the people. Those arms cache - who gave supplied it and from whose authority? Even the creation of that private army - who gave the authority? Malacanang must hide these facts by hook or by crook! Media should not be pushed aside by the petty reasoning!

I wonder why noone has still not dared to file suit against the Ampatuans, the Head of the Armed Forces, Sec Puno and include GMA for treason...the hidden arsenal alone is enough evidence that people's money was used in the sale of these weapons to private citizens who have their own private army > "sleeping with the enemy" so to speak. Gadamet, what are we waiting for??!!!

I'm skeptical, very skeptical, of the need of martial law in Maquindanao. GMA has a history of incompetent over-reaction when using force: the '03 killing of Panfilo Villaruel when he took over the airport; the '06 State of Emergency; and the '07 storming of the Peninsula Hotel. First, she panics, then tries to look tough and over-reacts, and finally ends looking weak and incompetent. Is this more of the same?

While I'm supportive of the declaration of Martial Law if it ultimately means the return of control of Maguindanao from the Ampatuans to the government, I consider the following points as equally important:

1. That EO 546 be revoked immediately and all CVOs absolutely disarmed and dismantled, regardless of location within the country
2. That the objectives of Martial Law in Maguindanao be made clear and transparent
3. That once these objectives are met martial law be lifted
4. That Martial Law not be expanded to cover the whole country.

All of us must remain vigilant so that this Martial Law declaration not be abused and lead to a Marcosian scenario.

If the Supeme Court decides that the declaration of Martial Law in Maguindanao was indeed unconstitutional, would'nt all the evidence gathered and all the arrest made during this period will be voided and therefore most of the accused will walk?

martial law declaration was very helpful. (period) di lang talaga kasi kayo napupunta sa maguindanao o medyo kunti lng ang alam nyo kung gaanu kalaki at mahirap na kalaban ang mga pamilyang involve.. try to get there and u'l see and might say " thank God, may martial law!" (period)
